Welcome to Sumitpage! By accessing or using our platform, you agree to these Terms and Conditions.

User Representations and Warranties

By uploading or submitting any content to Sumitpage, including but not limited to songs, images, videos, or other materials (collectively, "Content"), you represent and warrant that:

• You own or have obtained all necessary rights, licenses, consents, and permissions to use and upload the Content.
• The Content does not infringe upon or violate the intellectual property, privacy, publicity, or other rights of any third party.
• You have the full legal authority to grant Sumitpage and its affiliates the rights outlined in these Terms.

License to Use Content

By submitting Content, you retain full ownership of your music and all associated rights. Full stop.

These Terms do not transfer ownership of your Content to Sumitpage in any way.

You grant Sumitpage a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license solely to:

• Use, reproduce, distribute, modify, display, and perform your Content in connection with the operation, marketing, and promotion of the Sumitpage platform.
• Include your Content, as well as your name, likeness, and biographical information, in promotional materials in any media format related to the platform.

Your song will never be used to train a generative AI model.

The license granted here is strictly for platform promotion and operational purposes.

Streamers' Representations and Licenses

If you are a streamer using Sumitpage to review Content:

• You agree that Sumitpage may use your name, likeness, and any content from your streams in marketing and promotional materials.
• You grant Sumitpage the same non-exclusive, royalty-free, worldwide license as described above for any content generated during your streams.

Right to be Contacted

By using Sumitpage, you agree that Sumitpage and the host of any stream you participate in or view may contact you via email or other communication methods regarding updates, promotions, and other relevant communications.

Prohibited Activities

You agree not to:

• Upload or submit Content that is illegal, obscene, defamatory, hateful, or otherwise objectionable.
• Use Sumitpage to violate any applicable laws or regulations.

Sumitpage reserves the right to remove any Content that it deems, in its sole discretion, to violate these Terms.

Intellectual Property

Sumitpage respects intellectual property rights and expects its users to do the same. If you believe your intellectual property has been infringed upon, please notify us at support@sumitpage.com.

Third-Party Links and Content

The Sumitpage platform may contain links to external websites, streaming platforms, music services, or other third-party content and services. These links are provided for your convenience and reference only.

The fact that Sumitpage provides such links should not be construed as an endorsement, authorization, or sponsorship of that site, its content, or the companies or products referenced therein.

If you decide to access any third-party sites or services linked through the Sumitpage platform, you do so entirely at your own risk. You hereby irrevocably waive any claim against Sumitpage with respect to such external content.

Indemnification

You agree to indemnify and hold harmless Sumitpage, its affiliates, officers, directors, employees, and agents from any claims, damages, or expenses (including legal fees) arising out of or related to:

• Your Content
• Your use of the platform
• Any breach of these Terms

Limitation of Liability

To the maximum extent permitted by law, Sumitpage is not liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the platform.

Termination

Sumitpage may suspend or terminate your access to the platform at any time, with or without cause or notice.

Changes to the Terms

We may update these Terms from time to time. Any changes will be effective upon posting, and your continued use of the platform constitutes your acceptance of such changes.

Governing Law

These Terms are governed by and construed in accordance with the laws of California, without regard to its conflict of law principles.

Refund Policy

All sales are final and non-refundable.

• Skip the Line Submissions: Payments are non-refundable once the requested song has been added to the queue.
• Add-On Purchases: Add-ons are non-refundable once the service has been delivered or the product has been accessed, shipped, or used.

Sumitpage Partnership Program

The Sumitpage Partnership Program allows you to earn 5% commission on transactions made by users you refer for 2 years from their signup date.

• Referred users must sign up using your unique referral code.
• Commissions are calculated on net transaction amounts and paid monthly when your balance reaches $50.
• Payments may be withheld for up to 60 days.
• Fraudulent activity is prohibited.
• You are responsible for taxes and required documentation.
• You may not alter Sumitpage's branding or register domains using similar terms.
• Sumitpage may modify or terminate the program at any time.
• You are an independent contractor.
